Consumer terms for purchases made through www.gummipopz.co.uk

These terms apply to consumer purchases for personal use. Wholesale and trade enquiries or orders are subject to separate written trade terms and are not governed by these consumer terms.
1. About us and these terms
www.gummipopz.co.uk is operated by Stateside Distribution Limited, trading as Gummi Popz UK, a company registered in England and Wales.

These terms govern your use of the Website and consumer orders placed through it. Please read them before placing an order. The terms in force when you place your order will apply to that order. Our Privacy Policy, Cookie Policy and the delivery information shown at checkout also form part of the information we provide to you.
2. Who may place an order
You must be at least 18 years old, capable of entering into a legally binding contract and purchasing for personal or household use. If you are purchasing for a business, resale or commercial purpose, please contact our wholesale team and use the applicable trade terms.
3. Using the Website
- Use the Website only for lawful purposes and provide information that is accurate, current and complete.
- Do not interfere with the Website, attempt unauthorised access, introduce malicious code, scrape content at scale or misuse another person's account.
- Do not use Website content or product information in a misleading way or in a way that infringes our or another person's rights.
- We may restrict access or suspend an account where reasonably necessary for security, fraud prevention, legal compliance or a material breach of these terms. This will not remove rights relating to an order already accepted.
4. Products, ingredients and allergens
We take reasonable care to describe products accurately. Product images are illustrative and packaging, colours or minor design details may change, but the product supplied must materially match its description and all legally required product information.
Ingredients, allergens, net quantity, storage information and any warnings required for food or toy components must be available before you place an order and must also appear on the product or packaging where required. Always check the label on the product delivered before consumption, particularly if you have an allergy or dietary requirement. If the delivered label conflicts with the Website, or you have any concern, do not consume the product and contact us immediately. Nothing in this clause limits our responsibility to provide accurate mandatory information or safe, compliant products.
We will not substitute a materially different product, flavour, pack size or product variant without your agreement.
5. Prices, VAT, delivery charges and promotions
- Consumer prices are shown in pounds sterling and include VAT where applicable.
- Delivery charges and any other mandatory charge will be shown clearly before you submit the order. We will not add a mandatory charge after the order without your express agreement.
- Optional extras will not be added through pre-ticked boxes or without your express consent.
- Prices may change before an order is placed, but a later price change will not affect an order we have accepted.
- Promotions, discount codes, free-delivery offers and competitions may have additional terms shown with the offer. They must be used within their stated period and cannot be applied retrospectively unless the offer says otherwise.
- If a price is obviously incorrect, we may decline the order before dispatch. We will contact you and refund any payment taken. We will not cancel merely because a product later becomes more expensive.
6. Placing an order and contract formation
- Add the products you wish to purchase to your basket, review the basket and correct any errors.
- At checkout, review the total price, delivery option, delivery restrictions and accepted payment methods.
- Use the clearly labelled payment button to place an order and acknowledge your obligation to pay.
- We will send an order acknowledgement. This confirms receipt only and is not acceptance.
- A contract is formed when we send a dispatch confirmation for the relevant products. If products are dispatched separately, a separate contract is formed for each dispatch.
We may decline an order before dispatch where a product is unavailable, payment cannot be authorised, delivery restrictions apply, we reasonably suspect fraud or misuse, the order is for unauthorised resale, or there is an obvious pricing or product-information error. We will explain the reason where reasonably possible and refund any payment taken for products not accepted.
7. Payment
Accepted payment methods are shown at checkout. Payment may be authorised or taken when you place the order. If we do not accept all or part of the order, we will release the authorisation or refund the relevant amount without undue delay. You confirm that you are authorised to use the payment method provided.
8. Availability, quantity limits and pre-orders
All products are subject to availability. We may apply reasonable quantity limits to protect product availability and prevent unauthorised resale. If we cannot supply a product, we will not send a substitute without your consent.
If we offer pre-orders, the product page will clearly state the expected availability, payment timing and whether other items in the same order will be held. Any stated date is an estimate unless expressly confirmed as a guaranteed date. You may cancel a pre-order before dispatch and receive a refund, subject to any separate lawful terms displayed before purchase.
9. Delivery
- Available delivery services, current charges, geographical restrictions and estimated timeframes are shown on our Shipping Information page and at checkout. The information shown when you order forms part of the contract.
- We normally process orders Monday to Friday, excluding bank holidays. Dispatch and delivery estimates are not guarantees unless we expressly agree a guaranteed date or service.
- If no delivery date is agreed, we will deliver without undue delay and no later than 30 days after the contract is formed.
- We are responsible for the goods until they come into your physical possession, or the possession of a person you identify to receive them, unless you independently appoint a carrier that we did not offer.
- If our carrier loses, damages or misdelivers a parcel before delivery, this is our responsibility. You are not required to pursue the carrier.
- You are responsible for providing a complete and accurate delivery address. If delivery fails because the address you supplied was incorrect or nobody was available after reasonable attempts, we may charge reasonable and evidenced redelivery or return costs.
- Any additional remote-area delivery charge must be shown before you place the order or separately agreed by you before the contract is changed.
- If delivery by an agreed date was essential, or we fail to deliver within an additional reasonable period you give us, you may have the right to end the contract and receive a refund. Your statutory rights are not affected.
10. Your right to cancel for a change of mind
For most online consumer purchases, you may cancel without giving a reason from the date the contract is formed until 14 days after the day you, or a person you nominate, receives the goods. If one order is delivered in separate instalments, the period normally runs from the day after the final instalment is received.
To cancel, send a clear statement to info@gummipopz.co.uk before the cancellation period ends. Include your name, order number and the products being cancelled. You may use the model cancellation form at the end of these terms, but you do not have to.
After cancelling, you must send the goods back within 14 days to the return address we provide. Unless the goods are faulty, damaged, incorrect or we agree otherwise, you are responsible for the direct return cost. You must take reasonable care of the goods and may inspect them only as you reasonably could in a shop.
11. Exceptions to change-of-mind cancellation
The change-of-mind right does not apply where a statutory exception applies. Relevant examples may include:
- goods that are liable to deteriorate or expire rapidly;
- sealed goods that are not suitable for return for health-protection or hygiene reasons once they have been unsealed after delivery; and
- goods made to your specifications or clearly personalised.
Food or confectionery is not automatically excluded merely because it is edible. We will rely on an exception only where the legal conditions are met. These exceptions do not affect your rights if goods are faulty, unsafe, damaged, incorrect or not as described.
12. Refunds after change-of-mind cancellation
- We will refund the price paid and the cost of our least expensive standard delivery option. If you selected a more expensive service, we do not have to refund the additional delivery premium.
- We may wait until we receive the goods back or you provide evidence that you sent them, whichever occurs first.
- We will make the refund without undue delay and no later than 14 days after the relevant return or evidence is received.
- We will use the original payment method unless you expressly agree otherwise, and we will not charge a refund fee.
- We may make a lawful deduction for loss in value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods, provided we gave you the required cancellation information.
13. Faulty, unsafe, damaged, missing or incorrect goods
We are responsible for supplying goods that are of satisfactory quality, fit for purpose, as described and compliant with applicable law. Your rights include the short-term right to reject qualifying faulty goods, normally within 30 days, followed where applicable by rights to repair, replacement, price reduction or final rejection. A shorter period may apply where the expected life of a highly perishable product is less than 30 days.
Contact info@gummipopz.co.uk as soon as reasonably possible if goods are damaged, missing, incorrect, unsafe or defective. Photographs of the product, packaging, batch details and delivery label may help us investigate, but failing to provide photographs does not remove your legal rights. We will bear reasonable return or collection costs where the goods do not conform to the contract.
Do not consume a product that appears unsafe, contaminated, incorrectly labelled or affected by an undeclared allergen. Keep the product and packaging unless we advise otherwise so that we can investigate and, where necessary, take product-safety action.
14. Customer accounts
If you create an account, keep your password confidential and notify us promptly if you suspect unauthorised use. You are responsible for information and activity you knowingly authorise. We may require password resets or suspend access where reasonably necessary for security, but this does not affect accepted orders or statutory rights.
15. Reviews and other user content
You may submit genuine reviews, photographs, comments or other content where the Website permits. You confirm that you have the necessary rights, that the content reflects a genuine experience, and that it is lawful, accurate, non-defamatory and does not disclose another person's private information.
You grant us a non-exclusive, royalty-free licence to host, reproduce and display submitted content on the Website and in Gummi Popz UK's owned marketing channels for the purpose for which it was submitted. We will seek separate permission before materially altering your content or using it in paid advertising in a way that identifies you. You may request removal, subject to reasonable legal, evidential and record-keeping needs.
We may moderate or remove content that is fake, incentivised without disclosure, irrelevant, abusive, unlawful, misleading, infringes rights or contains personal data. We will not remove a genuine review merely because it is negative. We may take reasonable and proportionate steps to verify that a review reflects a genuine experience.
16. Intellectual property
The Website and its content are owned by Stateside Distribution Limited or used under licence. Gummi Popz and other trade marks belong to their respective owners. You may view and print reasonable extracts for personal, non-commercial use. You must not copy, modify, distribute, sell, scrape, create derivative commercial materials from or otherwise exploit Website content without permission, except where the law allows.
17. Website availability and third-party links
We aim to keep the Website available and accurate, but may suspend or change it for maintenance, security, legal or operational reasons. Website interruptions do not affect your rights under an accepted order. Third-party links are provided for convenience; we are not responsible for third-party content or privacy practices, but nothing in this clause excludes responsibility where the law says we are responsible.
18. Our responsibility for loss or damage
We are responsible for loss or damage that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. Loss is foreseeable if it was obvious that it would happen or both you and we knew it might happen when the contract was formed.
These consumer terms apply only to personal and household purchases. We are not responsible under these terms for business losses such as loss of profit, revenue, business opportunity or business interruption.
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, defective products where liability cannot lawfully be excluded, breach of your statutory rights, or any other liability that cannot lawfully be limited or excluded.
19. Events outside our reasonable control
We are not responsible for delay caused by an event outside our reasonable control where we take reasonable steps to minimise the impact. We will contact you as soon as reasonably possible. If the delay is likely to be substantial, you may contact us to cancel the affected products and receive a refund. This clause does not remove statutory delivery or refund rights.
20. Privacy and cookies
Our Privacy Policy explains how we collect and use personal information. Our Cookie Policy explains how cookies and similar technologies are used and how you can manage optional technologies. These policies do not reduce your rights under data-protection law.
21. Changes to these terms
We may update these terms for future Website use and future orders. The date at the top will show the latest revision. Changes will not alter a contract already formed unless the change is required by law or you expressly agree to it. Continued browsing alone does not vary the terms of an existing order.
22. Complaints and alternative dispute resolution
Please send complaints to info@gummipopz.co.uk with your order number and a clear description of the issue. We aim to acknowledge enquiries within two working days and will investigate fairly and without undue delay.
If we cannot resolve a consumer complaint after our internal process, we will provide any information about an appropriate accredited alternative dispute resolution provider that the law requires, including whether we are obliged or prepared to use that provider. This does not prevent either party from using the courts.
23. Governing law and courts
These terms and consumer orders are governed by the law of England and Wales. You retain any mandatory consumer protections that apply in the part of the United Kingdom where you live. If you live in England or Wales, the courts of England and Wales will have jurisdiction. If you live in Scotland, you may bring proceedings in the Scottish courts. If you live in Northern Ireland, you may bring proceedings in the Northern Irish courts.
24. General legal terms
- If a court finds part of these terms unlawful or unenforceable, the remaining terms will continue to apply.
- If we delay enforcing a right, that does not mean we waive it.
- The contract is between you and Stateside Distribution Limited. No other person has a right to enforce it, except where legislation gives them a right.
- We may transfer our rights and obligations only where this does not reduce your rights. You may transfer your rights where the law permits or with our written agreement.
